DACA Recipients: Get Ready to Enroll in Health Insurance

Are you one of New Mexico’s nearly 5,000 Dreamers? The federal government issued a rule change in 2024 that means Deferred Action for Childhood Arrivals (DACA) recipients in New Mexico may now be eligible for health care insurance coverage through BeWell, New Mexico’s health insurance marketplace! 

The rule change, which starts November 1, 2024, also means DACA recipients may be eligible for subsidies such as Advance Premium Tax Credits (APTC) and Cost Sharing Reductions (CSR) to help cover the cost of monthly health insurance premiums.

How have the rules changed?

In May 2024, the Centers for Medicare & Medicaid Services (part of the U.S. Department of Health and Human Services) ruled that DACA recipients will now be regarded as “lawfully present”.  

This designation is used only by the CMS in regard to the Affordable Care Act. It will not change or affect your immigration status. 

How soon can my insurance coverage start?

DACA recipients can apply for BeWell marketplace coverage beginning November 1, with coverage beginning as early as December 1. You’ll have 60 days to take advantage of the special enrollment period, so don’t miss the January 15 deadline! 

  • Apply during November 2024: Coverage can begin December 1, 2024 
  • Apply during December 2024: Coverage can begin January 1, 2025 
  • Apply during January 2025: Coverage can begin February 1 or March 1

What insurance plans will be open to DACA recipients?

If you meet all the qualifications for coverage, you can choose from any carrier in the BeWell marketplace. Talk with a BeWell Certified Assister about subsidies to help lower the cost of your monthly premiums.

Does the new federal rule affect Medicaid or CHIP coverage?

No—the definition of “lawfully present” for Medicaid and the Children’s Health Insurance Program (CHIP) coverage will continue to be determined by each state. 

While DACA recipients in New Mexico don’t qualify for Medicaid, they may qualify for marketplace coverage with APTC, even if their household income is below 100% of the Federal Poverty Level (FPL).
